1. Acceptance and Scope
These Terms and Conditions govern access to www.amironline.co.za and purchases from Amir Online. By using the website, opening an account or placing an order, the customer agrees to these terms. Nothing in these terms limits any right that cannot lawfully be limited under South African law.
2. Customer Eligibility and Information
A customer must be at least 18 years old and legally capable of entering into a contract. The customer must provide accurate billing, delivery and contact information and keep account credentials secure.
3. Products, Prices and Availability
Product descriptions, photographs and specifications are provided in good faith. Colours and appearance may vary slightly by screen or production batch. Prices are displayed in South African rand and include VAT where applicable. Stock and promotional offers remain subject to availability. Amir Online may correct an obvious pricing, description or stock error before dispatch and will offer the customer a corrected order or a full refund.
4. Orders and Formation of the Sale
Submitting an order is an offer to purchase. An automated acknowledgement does not guarantee acceptance. The sale is accepted when Amir Online confirms payment and dispatch, subject to stock availability, fraud checks and lawful restrictions. Amir Online may decline or cancel an order for a legitimate reason and will refund amounts paid for any cancelled item.
5. Payment
Payment must be made through a method displayed at checkout, including Yoco where offered. Customers confirm that they are authorised to use the selected payment method. Card and banking details entered on a payment provider’s secure page are handled under that provider’s security and privacy terms.
6. Cancellation, Returns and Refunds
The separate Amir Online Refund and Cancellation Policy forms part of these terms. It explains pre-dispatch cancellations, the statutory cooling-off right applicable to qualifying electronic transactions, unwanted returns, incorrect items, damaged deliveries and defective goods.
7. Delivery
The separate Amir Online Delivery Policy forms part of these terms. Orders are generally fulfilled through The Courier Guy or another disclosed delivery partner. Delivery dates are estimates unless expressly guaranteed. The customer must provide a complete, serviceable address and ensure an authorised person can accept the parcel.
8. Inspection and Risk
Customers should inspect the parcel as soon as reasonably possible and report visible damage, missing items or an incorrect product promptly. Acceptance by a person at the supplied address may constitute proof of delivery, but does not remove statutory rights concerning defective, unsafe, damaged or incorrectly supplied goods.
9. Warranties and Consumer Rights
Goods are supplied with the protections required by the Consumer Protection Act 68 of 2008, including the applicable implied warranty of quality. Remedies may include repair, replacement or refund where the law provides. Manufacturer warranties may apply in addition to, and not instead of, statutory rights.
10. Website Use and Intellectual Property
Website content, branding, text, graphics and product presentation belong to Amir Online, Amir Group or their licensors. Customers may use the website for lawful personal or business purchasing only. Unauthorised scraping, interference, copying, fraud or misuse is prohibited.
11. Privacy and Communications
Personal information is processed for account administration, payment, fulfilment, customer support, fraud prevention and lawful marketing in accordance with the Amir Online Privacy Policy and applicable law. Necessary delivery information may be shared with The Courier Guy or another delivery partner solely to fulfil an order.
12. Liability
Amir Online is not liable for indirect or consequential loss except where liability cannot lawfully be excluded. Nothing in these terms excludes liability for gross negligence, intentional misconduct, unsafe goods or any other liability that South African law does not permit a supplier to exclude.
13. Events Outside Reasonable Control
Amir Online will not be responsible for delay caused by events reasonably outside its control, including severe weather, road closures, civil disruption, load-shedding impacts, courier network interruption or natural disaster. Amir Online will communicate material delays and continue to assist the customer.
14. Complaints and Disputes
Customers should first contact Amir Online at info@amironline.co.za or 084 377 8901. If a complaint is not resolved, a consumer may approach the Consumer Goods and Services Ombud or another competent regulator. These terms are governed by South African law and disputes may be brought before a court or tribunal with lawful jurisdiction.
15. Changes and Severability
Amir Online may update these terms prospectively by publishing a revised version. The terms applicable when an order was placed continue to govern that order unless a change is required by law. If one provision is invalid, the remaining provisions continue to apply.
